Introduction
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, “your”) and DEEPCASTR SAS, a company incorporated under French law, operating under the commercial name Creaboost (“Creaboost”, “we”, “us”, “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
1. Definitions
- “Agreement” means these Terms and any applicable subscription or order form.
- “Services” means the Creaboost platform, including all features, modules, APIs, integrations, and related services.
- “Customer Data” means any data, content, or information provided, uploaded, or accessed by Customer through the Services.
- “Permitted Users” means individuals authorized by Customer to access the Services.
- “Third-Party Products” means third-party platforms or services (including Meta, TikTok, Google, Shopify, etc.).
- “Generative AI” means any functionality that generates content (text, images, video, or other outputs) based on user inputs.
1.1 Definitions specific to Neo
- “Neo” means the AI agent of the Services dedicated to each Brand, which reads Customer Data, analyzes it and proposes Deliverables, decisions and content.
- “Brand” means a brand of Customer set up in the Services, with its connected accounts, its memory and its Deliverables.
- “Workspace” means Customer’s space in the Services, which holds one or more Brands and their Permitted Users.
- “Claude Subscription” means Customer’s own subscription to Claude, contracted directly with Anthropic, on which Neo runs.
- “Deliverables” means the boards, docs, audits, reviews, briefs, concepts, scripts, reports, summaries and other outputs Neo produces for Customer.
- “Tasks” means the runs of Neo that Customer schedules, including unattended runs.
2. About the Services
Creaboost is a software-as-a-service platform that enables users to:
- discover and analyze advertising creatives,
- generate creatives using artificial intelligence,
- measure and optimize marketing and creative performance.
The Services may include browser extensions, APIs, and integrations with third-party advertising libraries and platforms.
2.1 Neo, the AI agent of each Brand
The Services include Neo. Neo reads the data of the accounts Customer connects to a Brand, analyzes it with Creaboost’s methods (skills) and the Brand’s memory, and proposes Deliverables, decisions and content through Chat, Boards, Docs, Tasks, Skills and Brands. Neo reads, analyzes and proposes; its access to Customer’s ad accounts is read-only (9.4).
2.2 Scheduled Tasks and unattended runs
Customer schedules Tasks at the cadence of its choice. Before creating, changing, pausing or deleting a Task, Neo shows its name, its next runs, a summary of its instructions, its exports and its destinations, and waits for the Permitted User’s approval. A Task runs only on the instructions stored with it: everything Neo reads during a run (ad copy, files, emails, messages, web pages) is treated as data, never as instructions.
During an unattended run, Neo sends, writes and publishes only to the destinations named in the Task or to the channel the Permitted User chose for the Brand. On its own, it does not change ad accounts, make purchases, create Tasks, create new sharing, delete content or set up connectors. When something it needs is missing, it stops, saves what was done and reports what is missing.
3. Account Registration and Use
To use the Services, you must:
- be at least 18 years old;
- provide accurate, complete, and up-to-date information;
- maintain the confidentiality of your login credentials.
Accounts are personal and non-transferable, and not shareable except through authorized workspace access.
If you use the Services on behalf of a company, you represent and warrant that you have authority to bind that entity, and the entity is jointly and severally liable under this Agreement.
You agree not to create multiple accounts to circumvent usage limits, pricing, or restrictions. We may suspend or terminate accounts that violate this policy.
3.1 Workspaces, Brands and Permitted Users
A Workspace holds one or more Brands. A Permitted User of a Workspace can work with Neo on every Brand of that Workspace, including in sessions that cover several Brands. Customer decides who is a Permitted User and is responsible for their actions in the Services, including the Tasks they approve.
4. Subscription and Billing
Access to the Services requires a paid subscription unless otherwise stated.
- Subscriptions are billed in advance on a recurring basis (monthly, quarterly, or yearly).
- All fees are non-refundable, except where required by law.
- Subscription terms, pricing, and features are described on our website and may be updated from time to time.
Creaboost may change pricing with reasonable notice, suspend access in case of non-payment, or modify/discontinue features.
4.1 Claude Subscription and AI credits
Neo requires a Claude Subscription. Customer contracts for it and pays for it directly with Anthropic; it is outside this Agreement and Creaboost’s fees. Creative reading (the description of Meta images and videos by an AI model) uses AI credits: one credit per new creative or new question, while descriptions already computed are reused at no cost. The Discover, Create and Analyze modules keep their own credits.
5. Availability
We aim to provide a high level of availability but do not guarantee uninterrupted or error-free operation. The Services may be unavailable due to maintenance, technical issues, third-party failures, or force majeure events.
5.1 Anthropic and data freshness
Neo depends on Anthropic’s services and on the usage limits of Customer’s Claude Subscription. Creaboost is not responsible for their availability or their limits. When the usage limit is reached, a scheduled Task may be deferred; its run history shows it. Data freshness depends on each source: Meta and Shopify are read live, the other sources are synced several times a day.
6. Intellectual Property
6.1 Creaboost IP
Creaboost retains all rights, title, and interest in and to the Services; software, models, algorithms; UI/UX, documentation, and infrastructure. No rights are granted except as expressly set forth in this Agreement.
6.2 Customer Data
Customer retains all rights in Customer Data. Customer grants Creaboost a limited, non-exclusive, worldwide, royalty-free license to host, process, analyze, and display Customer Data solely for the purpose of providing the Services.
6.3 Strict Data Use Commitment
Creaboost strictly commits that it:
- Does not sell Customer Data;
- Does not use Customer Data for advertising targeting or resale;
- Does not train any generalized AI or machine learning models on Customer Data, under any circumstances.
6.4 Third-Party Content
The Services may display content sourced from third-party platforms (e.g., ad libraries). Creaboost does not own such content. Use outside the Services must respect applicable intellectual property laws.
6.5 Feedback
Any feedback, suggestions, or feature requests provided by you become the exclusive property of Creaboost and may be used without restriction or compensation.
6.6 Brand memory and Deliverables
The memory of each Brand, the Deliverables, the files Customer uploads and the pages Customer publishes are Customer Data. Creaboost’s methods (skills), templates and formats remain Creaboost IP. The commitment of 6.3 covers all the data Neo reads and writes.
7. Generative AI Services
The Services may include Generative AI features. Due to the nature of machine learning, special conditions apply:
7.1 No Warranty
Generative AI outputs may be inaccurate, incomplete, or biased; may infringe third-party rights; and are provided “as is” with no warranty.
7.2 User Responsibility
You are solely responsible for prompts submitted, outputs generated, and how such outputs are used.
7.3 Prohibited Uses
You agree not to use Generative AI to infringe intellectual property rights; generate misleading or unlawful content; or impersonate or deceive.
7.4 Full Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Creaboost from any claim arising from:
- AI-generated content
- Misuse of outputs
- Infringement or unlawful use
7.5 Neo runs on Claude, under Customer’s agreement with Anthropic
Neo is an AI agent that runs on Claude Code, Anthropic’s official tool, with Customer’s own Claude Subscription. Customer contracts directly with Anthropic and accepts Anthropic’s terms and usage policies; each Permitted User signs in to Claude through Anthropic’s own flow. Creaboost never sees or stores Claude credentials.
The prompts and the data processed by the Claude model are handled under Customer’s agreement with Anthropic: their use and retention by Anthropic follow the terms of Customer’s Anthropic plan. Creaboost itself trains no model on Customer Data (6.3).
7.6 Recommendations and decisions
Neo’s analyses, recommendations, decisions, concepts, scripts and other Deliverables are suggestions. Customer reviews them and decides whether and how to apply them. Creaboost guarantees no result (spend, revenue, CPA, ROAS or any other metric). Customer remains responsible for the changes it makes to its ad accounts and for the ads it publishes, including their compliance with the law and with each platform’s advertising policies.
8. Data Protection and Privacy
Creaboost processes Personal Data in accordance with its Privacy Policy. You represent that you have all necessary rights and legal bases, and you have obtained required consents. Where required, a Data Processing Agreement may apply.
8.1 Dedicated infrastructure
Each Brand has a dedicated machine, which stores its memory and its Deliverables. Each Workspace has one machine on which the Permitted Users’ Claude Code sessions run, including sessions that cover several Brands. Brand data is reached only through Creaboost’s own access layer (the Creaboost MCP).
When Customer deletes a Brand, its machine, its memory, its Deliverables and its uploaded files are deleted within 30 days. The same applies to the Workspace machine when the Workspace is closed.
8.2 Personal data in Neo’s work
Neo works on aggregates. Brand memory and Deliverables hold no personal data of Customer’s own customers: reviews are quoted without names, and no customer contact details or photos are stored in them. The Privacy Policy details the data Neo processes.
9. Third-Party Products and APIs
9.1 No Control
Creaboost is not responsible for Third-Party Products or their availability, accuracy, or compliance.
9.2 OAuth Authorization
You may grant access to third-party data via OAuth. You may revoke access at any time; functionality may be impacted as a result.
9.3 Platform Compliance
You agree to comply with all applicable third-party terms, including Meta Platform Terms, Google API Services User Data Policy, TikTok and others. You may not use the Services for surveillance, profiling individuals, enforcement or discriminatory purposes, or any prohibited use under platform policies.
9.4 Read-only access to ad platforms
In the current version of the Services, Neo has read-only access to Customer’s ad accounts: it does not create, change, pause or delete any campaign, ad set, ad group, ad, budget, audience, creative, feed or page. Platform tokens are kept in an isolated Creaboost service and are never exposed to the agent. Connected sources are tied to the Brand, never to a user.
Customer may send a connection link to the person who holds an access. That person authorizes the connection through the platform’s own login, without a Creaboost account, and Customer or that person may revoke it at any time.
9.5 Work tools connected to Claude
Slack, Gmail, Google Drive, Google Slides, Sheets and Docs, Notion and other work tools are Claude connectors that Customer connects with its own accounts. The actions Neo takes through them on Customer’s instructions (posting a message, sending an email, creating or updating a file) are made with Customer’s accounts, under Customer’s responsibility and under the terms of those tools. Creaboost never sees their credentials. Scheduled Tasks act only on the destinations Customer names.
10. Acceptable Use
You must not:
- violate laws or third-party rights;
- reverse engineer or copy the Services;
- build a competing product;
- resell or provide access to third parties;
- scrape or extract data unlawfully;
- bypass security or rate limits;
- introduce malicious code;
- engage in fraud, phishing, or spam;
- upload unlawful or infringing content.
10.1 Use of Neo
When using Neo, you must also:
- use it only for the accounts and Brands you are authorized to manage;
- comply with Anthropic’s usage policies and with the advertising policies of each platform;
- not attempt to reach the data of another Workspace;
- not place instructions in the content Neo reads in order to make it bypass its rules.
11. Confidentiality
Each party agrees to protect confidential information and use it solely for purposes of this Agreement.
12. Termination
You may cancel your subscription at any time. Access continues until the end of the billing period.
Creaboost may suspend or terminate for breach of these Terms, for non-payment, or for legal or security risks.
12.1 Deletion after termination
At the end of the subscription, the Brand machines, the Workspace machine, the memory, the Deliverables and the uploaded files are deleted within 30 days, and other Customer Data is deleted or anonymized within the same period, as set out in the Privacy Policy. Customer may export its Deliverables before that date. Published pages stop being accessible.
13. Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREABOOST DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Creaboost shall not be liable for indirect, incidental, or consequential damages;
- Total liability shall not exceed the fees paid in the 12 months preceding the claim.
This limitation applies regardless of the legal theory.
14.1 Third-party services and decisions
Creaboost is not liable for the services of Anthropic or of the tools connected to Claude, for the actions taken through them on Customer’s instructions, or for the outcome of decisions Customer takes on the basis of Neo’s Deliverables, including ad spend.
15. Governing Law
These Terms are governed by the laws of France.
Exclusive jurisdiction: Courts of Paris
16. General
- Creaboost may update these Terms with reasonable notice.
- Continued use constitutes acceptance of the updated Terms.
- Invalid provisions do not affect the remainder of the Agreement.
- No partnership or employment relationship is created by this Agreement.
